Trolle na podzielonym rynku. Patent europejski o jednolitym skutku a rynek wewnętrzny i prawo konkurencji

Celem artykułu była identyfikacja wyzwań związanych z wejściem w życie systemu jednolitej ochrony patentowej w Unii Europejskiej (tj. patentu europejskiego o jednolitym skutku). Wbrew nazwie, system ten będzie miał niejednolitą formę prawną (ustanowiony zostanie na podstawie dwóch rozporządzeń - źródeł prawa unijnego oraz umowy międzynarodowej) i terytorialną (wskutek zastosowania procedury wzmocnionej współpracy nie będzie obowiązywał w Hiszpanii, a jego skuteczność będzie ograniczona we Włoszech i najprawdopodobniej w Polsce). Przyjęcie takich rozwiązań może implikować istotne wyzwania dla funkcjonowania rynku wewnętrznego Unii Europejskiej, gdyż trudno będzie ustalić, jakie przepisy prawa unijnego (zwłaszcza regulujące swobodę przepływu towarów) znajdą zastosowanie do działań podmiotów uprawnionych z patentu europejskiego o jednolitym skutku. Rodzi to fundamentalne pytanie o pewność prawa, a w konsekwencji: pewność obrotu gospodarczego w Unii. Drugą istotną kwestią jest wyzwanie, jakie niesie dla prawa konkurencji reżim językowy (patenty będą przyznawane w języku angielskim, niemieckim lub francuskim i nie będą tłumaczone na inne języki państw członkowskich, w których będą obowiązywały) oraz system rozwiązywania sporów, przyjęte w ramach jednolitej ochrony patentowej. W związku z tym w niniejszym artykule podjęto próbę odpowiedzi na pytanie, czy taka konstrukcja systemu nie ustanowi warunków dla rozwoju negatywnego zjawiska trollingu patentowego w Unii Europejskiej, co w długim okresie może prowadzić do obniżenia konkurencyjności gospodarki unijnej.
